“Lebendes Recht” is a concept proposed by Eugen Ehrlich that refers to the norms of behavior in people’s everyday lives. Of course, within these “Lebendes Recht,” current constitutional, civil, and criminal laws are included as codified laws.
However, these laws are merely one ideational type of behavioral norm crafted by humans, and human behavior is not solely regulated by these laws.
This is because behavioral norms vary according to culture, region, age, race, etc.
The purpose of this session is to explore the possibilities of a broader, interdisciplinary legal study (generative jurisprudence) through dialogue with legal anthropologists who take “Lebendes Recht” as their primary research subject, as opposed to the narrower traditional legal studies focused only on law, such as doctrinal and interpretive jurisprudence.

「生ける法」とはオイゲン・エールリッヒが提唱した概念で人々の日常生活におけるあらゆる行動規範を指す。
「生ける法」には、現行の憲法、民法、刑法などの法律がもちろん含まれているが、これらの法律は人が創り出した行動規範の一つの理念型に過ぎず、人の行動が必ずしも法律によってのみ規範されるわけではない。
なぜなら、行動規範が文化、地域、年齢、人種などによって多様かつ多元だからである。
本セッションでは、「生ける法」を主な研究対象とする法人類学者との対話を通じ、従来の法律学が取り扱う狭義の法学（教義法学や解釈法学）とは異なる、より広義の学際的な法学（創成法学）の可能性を探求することを目的とする。
